Herzog Foundation Wins Landmark Injunction Over Biden-Era Pregnancy Rule
The Herzog Foundation commends the U.S. District Court for the Western District of Missouri for granting a permanent injunction protecting the rights of faith-based employers under federal law. The injunction bars the Equal Employment Opportunity Commission (EEOC) from enforcing its Biden-era Pregnant Workers Fairness Act (PWFA) rule against the Herzog Foundation.
The permanent injunction, following a preliminary injunction granted in March, provides ongoing protection for the Herzog Foundation and affirms that Christian organizations cannot be compelled to follow policies that conflict with their religious beliefs.
“We are encouraged that the courts continue to recognize the importance of protecting religious freedom for faith-based employers like us. This permanent injunction solidifies that the government cannot overstep its authority by trying to dictate or suppress our beliefs, allowing our organization and countless other faith-based organizations to operate in a way that honors both our mission and our values,” said Elizabeth Roberts, Communications Director for the Herzog Foundation.
“As counsel for the Herzog Foundation, we welcome the EEOC’s steps to reverse the prior administration’s unlawful use of civil rights laws against religious organizations. Congress never authorized the agency to promote abortion or force religious employers to violate their beliefs. This action restores the law to its proper purpose by supporting women, protecting life, and respecting religious liberty,” said Edward Greim, attorney at Graves Garrett Greim, which represented the Herzog Foundation.
The EEOC, under current Chair Andrea Lucas, agreed not to defend the Biden-era PWFA rule against the Herzog Foundation and other faith-based organizations. Combined with the court’s permanent injunction, this ensures that religious employers are no longer subject to regulations that infringe on their deeply held beliefs.
